ISLAMABAD: President Dr. Arif Alvi Friday approved the withdrawal of the Civil Miscellaneous Application (CMA) and curative review reference against the senior judge of the Supreme Court, Justice Qazi Faez Isa.
President Dr. Alvi approved the advice of Prime Minister Shehbaz Sharif in accordance with Article 48 of the Constitution.
Prime Minister on Thursday directed the law ministry to withdraw the reference filed against Justice Qazi Faez Isa.
The PM office said in a statement that the prime minister had directed Federal Law Minister to withdraw the reference against the honourable judge as it was politically motivated.
The premier said CRR was filed only to defame Justice Isa and his family members. This was not a reference but a victimization by revengeful Imran Khan against an impartial and unbiased person pursuing the course of law and constitution.
He remarked that this was a conspiracy to curb the independence of the judiciary and create a division in it.
SC squashes reference
The Supreme Court on 19 June quashed the presidential reference against Justice Isa after declaring it ”invalid”.
The detailed verdict released by the highest court nullified the presidential reference against Justice Faez Isa and termed it a violation of the constitution and law.
The Pakistan Tehreek-e-Insaf -led federal government, on 23 May 2019, had moved the Supreme Judicial Council against Justice Isa and Sindh High Court Judge Justice K K Agha over the non-disclosure of foreign assets of their families in their wealth statements.
However, in June 2020, the apex court expelled the presidential reference filed against Justice Faez Isa and the SJC proceedings that were started on the basis of the reference.
A ten-judge full court had issued the ruling after hearing for over 6 months a slew of petitions filed against the reference that claimed that Justice Faez Isa had committed misconduct by not disclosing his family’sfamily’s properties in the United Kingdom in his wealth statement.
