US Apex Court Allows Congress to Access Trump’s Tax Returns

The US Apex Court on Monday gave green signals for handing over President Donald Trump’s tax returns to congressional committees after three years.
The court, without any consensus, rejected Trump’s request for an order that would prevent the Treasury Department from giving six years of tax refunds for Trump to the Congress committee named Democratic-controlled Ways and Means Committee.

Alone among recent leaders, Trump has refused to release his tax returns during the successful 2016 campaign. He excused what he said was an ongoing investigation. before the IRS. Last week, Trump announced that he will run again in 2024.

According to the Associated Press, it was the president’s second top court win in as many months, and his third this year. The legal battle surrounding the FBI’s search of Trump’s estate in Florida that revealed classified documents.

In January, a court refused to prevent the National Archives from handing over documents to a House committee investigating the Jan. 6 on Capitol Hill. Justice Clarence Thomas was the only person who voted for Trump.

In a dispute over his tax returns, the Treasury Department refused to release those documents during the Trump administration. But the Biden administration has said federal law is clear that the committee has the authority to review any taxpayer’s return, including the president’s.

The lower courts agreed that the commission had broad authority to obtain tax returns and rejected Trump’s claim that it was passing and that it only required the documents to be made public.

Chief Justice John Roberts ordered a temporary stay on Nov. 1 to allow the court to review legal issues raised by Trump’s lawyers in opposition from the administration and the House of Representatives. Just over three weeks later, the court vacated Roberts’ order without comment.

The House argued that legislation preventing the IRS from issuing tax returns would leave lawmakers “little or no time to complete their legislative duties during this Congress, which is approaching quickly.”

If Trump gets the nation’s highest court to get involved, it could be too late for the committee, as Republicans will take over the House in January. They will almost certainly abandon the registration request if the problem is not resolved by then.

The House Ways and Means panel first subpoenaed Trump’s 2019 tax returns as part of an investigation into the Internal Revenue Service’s audit program and initial compliance with the tax law. A federal law states that the Internal Revenue Service “provides” every taxpayer with a tax return to the higher authorities.
