ISLAMABAD: The Supreme Court of Pakistan has fixed a plea against objections on the curative review reference against Justice Qazi Faez Isa for hearing. The Chief Justice of Pakistan (CJP), Umar Ata Bandial, will hear the plea.
The federal government’s plea seeking revocation of the curative review reference against Justice Isa is also scheduled to be heard on April 10.
Earlier, Prime Minister Shehbaz Sharif had ordered the withdrawal of the curative review reference against Justice Isa. The PM directed the law minister to withdraw the reference as the government had decided not to pursue it.
He claimed that Justice Isa and his family were harassed and defamed through the reference and that it was an attack on the independence of the judiciary and a nefarious conspiracy to divide the institution.
Reference against Justice Qazi Faez Isa
The reference was moved by the former Prime Minister Imran Khan’s government against Justice Isa, which was opposed by lawyers’ organisations, including the Pakistan Bar Council and the Pakistan Muslim League-Nawaz (PML-N) and allies.
The curative review reference is a rare legal recourse that allows a party to seek relief from a final judgment of the Supreme Court on the grounds of a violation of natural justice or a procedural error.
The hearing of the plea against objections on the curative review reference against Justice Isa will be closely watched as it has implications for the independence of the judiciary in Pakistan.
