SC Resumes Hearing in Petitions Challenging Supreme Court Procedure Law

ISLAMABAD: The Supreme Court (SC) has resumed the hearing of multiple petitions challenging the law that regulates the procedure of the top court and requires a committee of three senior judges to form benches for constitutional matters of public importance and suo-moto notices.

The hearing in the nine challenges to the Supreme Court (Practice & Procedure) Act, 2023 is being presided over by a 15-judge full court headed by Chief Justice Qazi Faez Isa.

The law passed by the parliament in April has been seen by the petitioners as an attempt by the government to curtail the chief justice’s powers and stepping into judiciary’s domain.

In April, the top court, then led by former chief justice Umar Ata Bandial, had barred the government from implementing the law until the petitions challenging it were decided.

On Monday, the Chief Justice observed that the parliament must not be hampered from doing something good merely because it lacks two-thirds majority.
