ISLAMABAD: Supreme Court on Thursday restored the No Objection Certificate (NOC) issued to the Park View Housing Society.
During the hearing, the apex court forwarded the matter to Chairman Capital Development Authority (CDA) and ordered him to submit a report after analyzing the ground situation. During the proceeding, the CDA lawyer contended that the Authority was not bound to allot land to Park View scheme for the construction of a road.
He said that CDA would grant NOC to the said society if it buys land to build the road. Advocate General Islamabad said that Park View had encroached the land. Meanwhile, the counsel of Park View City, argued that Advocate General was citing a former report of Deputy Commissioner Islamabad. He said the society’s land was worth 7,870 Kanal, but it had possession of only 5,745 Kanal.
Islamabad High Court had in December 2020 declared the NOC given to Park View City Housing Society as “illegal and void.” Chief Justice IHC Athar Minallah in his judgment declared that the land acquired under the Ordinance of 1960, vests in the State and it cannot be used, directly or indirectly, in violation of the scheme and provisions thereof.
Park View Housing Society is a real estate project owned by the disgruntled leader of Pakistan Tehreek-e-Insaf Abdul Aleem Khan.
The Park View Housing Society first got the NOC in 2013, before it was suspended by the former Pakistan People’s Party government in 2014.
The NOC was restored again in 2018, before it was challenged in the Islamabad High Court in 2020.
Park View Housing Society Chief Executive Officer Naveed Asghar lauded the court verdict and added that it will encourage the real estate market and will bring more investment to the country.
