Pakistan: Supreme Court to Hear ECP’s Appeal Pertaining to PTI’s Election Symbol

ISLAMABAD: The Supreme Court of Pakistan will hear the appeal of Election Commission of Pakistan (ECP) today against restoration of ‘bat’ as the election symbol of Pakistan Tehreek-e-Insaf (PTI), local media reported.

A three-member bench of the apex court, headed by Chief Justice of Pakistan Qazi Faez Isa and comprising Justice Musarrat Hilali, and Justice Muhammad Ali Mazhar will hear the case against the decision of Peshawar High Court (PHC).

The ECP, in its pela, said that the verdict of the Peshawar High Court was against the Constitution and law. The Peshawar High Court had restored the election symbol of PTI on the petition of the party a day back.

On Thursday, the Election Commission of Pakistan had challenged the PHC’s verdict in the SC, seeking to overturn the decision that invalidated its decision on Pakistan Tehreek-e-Insaf’s intra-party elections and the withdrawal of its election symbol.

In its plea submitted to the apex court, the Election Commission of Pakistan argued for the PHC verdict to be declared illegal, saying that the PTI had failed to conduct intra-party polls in compliance with the Election Act. This move followed a meeting where the Election Commission of Pakistan reviewed the PHC’s decision and discussed the possibility of approaching the apex court.

The Peshawar High Court had issued a short order earlier, declaring the ECP’s order of December 22, as “unconstitutional, without any legal authority and of no legal effect.” The court also directed the ECP to publish the certificate of PTI’s intra-party elections on its website and issued the election symbol under the Election Act.
