ISLAMABAD: The Ministry of Foreign Affairs has issued a statement acknowledging the recent decision of the Court of Arbitration concerning Pakistan’s arbitration request against India under the Indus Waters Treaty (IWT). The clarification, which relates to the Court’s ‘Award on Issues of General Interpretation of the Indus Waters Treaty’, was published on 8 August 2025.
In the release, Pakistan expressed appreciation for the Court’s clarification on certain aspects of the IWT, which are crucial for the ongoing arbitration process. The Court of Arbitration’s ruling helps in interpreting key provisions of the treaty and offers guidance on the issues raised by Pakistan in its case against India.
Furthermore, Pakistan took note of the Procedural Order issued alongside the ruling, which outlined the phased approach the Court will continue to follow in the proceedings. The Court has indicated that it will also consider the ongoing Neutral Expert proceedings under Article IX and Annexure F of the IWT, which were initiated following India’s request.
Neutral Expert proceedings
The Neutral Expert proceedings, which are a separate but connected aspect of the dispute resolution process, are set to continue with the next phase scheduled for Vienna from 17 to 21 November 2025. Despite India’s decision to halt its participation in the proceedings, Pakistan has reaffirmed its commitment to the process and continues to participate fully and in good faith.
Notably, the Neutral Expert has ruled that India’s non-participation will not halt the proceedings, allowing them to move forward as scheduled. This decision marks a significant step in the dispute resolution process, emphasizing the importance of adherence to the established mechanisms under the IWT.
Pakistan remains committed to resolving its concerns regarding the Indus Waters Treaty through established legal and diplomatic channels and will continue to engage constructively in the proceedings.
