ISLAMABAD: The Islamabad High Court (IHC) has scheduled a pivotal hearing regarding the appeal by Pakistan Tehreek-e-Insaf (PTI) chairman, seeking the restoration of his right of defense in the Toshakhana case.
Chief Justice of the Islamabad High Court, Justice Aamer Farooq, will preside over the hearing on August 10. The Chief Justice has issued notices to the Election Commission of Pakistan and other concerned respondents, seeking their responses on the matter.
In his petition, the former prime minister emphasized the fundamental importance of a fair trial, which the District & Sessions Court has denied.
The District & Sessions Court had revoked the petitioner’s defense rights due to the failure of his legal team to produce private witnesses on the specified date. Moreover, the court dismissed the list of four witnesses submitted in the case.
Simultaneously, the IHC has also scheduled another petition filed by Imran Khan for a hearing on August 8. This plea seeks his transfer from District Jail Attock to Central Jail Adiala Rawalpindi. The Chief Justice, Justice Aamer Farooq, will oversee the proceedings and consider the objections raised by the Registrar’s Office.
Imran Khan’s petition requests permission for Dr. Faisal Sultan, Chief Executive Officer of Shaukat Khanam Hospital, to conduct his medical examination. It also seeks approval for family members and lawyers to visit him. The former Prime Minister also requested for A-Class facilities in the jail. Currently, he has been given B-Class facilities.
PTI Challenges Imran Khan’s Conviction in Toshakhana Case
Meanwhile, Pakistan Tehreek-e-Insaf, led by Imran Khan, has also moved to the Supreme Court, seeking the annulment of the verdict by Additional and Sessions Judge (ADSJ) Humayun Dilawar in the Toshakhana case. The PTI’s petition invokes Article 184(2) of the Constitution, urging a fresh hearing and contending that the former Prime Minister was unjustly denied a fair trial.
The petition asserts that the denial of the fundamental right to a fair trial under Article 10A of the country’s Constitution has marred Imran Khan’s conviction in the Toshakhana case.
Imran Khan’s arrest and subsequent transfer to Attock jail on August 5 came in the wake of his conviction by the district and sessions court in the federal capital.
On August 5, the Additional and Sessions Judge (ADSJ) Humayun Dilawar’s disqualified Imran Khan for five years and sentenced him to three years in Toshkhana Case.
Acting swiftly on court orders, Police arrested Imran Khan from his residence in Lahore’s Zaman Park and subsequently transferred him to Attock jail.
