WASHINGTON: Former US President Donald Trump has asked a federal appeals court to throw out the election subversion criminal case in Washington, arguing that he is protected as per presidential immunity, CNN reported.

Doland Trump wants the Court of Appeals to downturn a lower-court verdict rejecting his claims of immunity in special counsel Jack Smith’s polls subversion case. The appeals panel is weighing Donald Trump’s plea, which the Supreme Court on Friday declined to take up on an expedited basis, as Smith pleaded.

According to CNN, the filing reiterates what the ex-president’s lawyers have repeatedly stated: that Donald Trump was working in his official capacity as president to “confirm polls integrity” when he supposedly undermined the 2020 poll results and therefore has protection and that his indictment is illegal as presidents cannot be criminally prosecuted for “official actions” unless they are prosecuted and convicted by the US Senate.

Trump’s lawyers wrote on Saturday: “The constitution setups a powerful structural check to halt political factions from abusing the difficult threat of criminal prosecution to inactivate the President and assault their political opponents.”

Donald Trump has been attempting to postponement his March 4 trial in the matter, with his contest over the immunity claim underscoring those attempts, CNN reported.
